Tyrese -- BOOTED from Radio Station for Talking About Liquor Stores Top

Filed under: Tyrese Gibson, Exclusive Details, Kids

Tyrese
claims he was WRONGLY kicked out of a radio station in Delaware yesterday -- and it's all because he TOOK A STAND against liquor stores that operate near elementary schools.

It all happened at WJKS KISS 101.7 in Delaware -- when Tyrese, who was invited on the show to promote his album, made a PASSIONATE statement about how liquor stores SHOULD NOT be allowed near schools ... after seeing one on his way to the station.

During his rant, Tyrese told the DJ, "Get them cats out of here ... selling alcohol right across from your kids school, homie -- put the pressure on them homie ... you know how to put pressure on dudes selling in your hood."

But when the show went to commercial, Tyrese was asked to leave the building -- and the owner of the radio station confirms to TMZ that it was because he felt Tyrese was "disrespecting" the Delaware community.

After the incident, Tyrese tweeted, "I just kicked out of a radio station frm a [program director] who had a problem w/ me speaking on liquor stores that are by elementary schools in Delaware."

He later added, "If you don't STAND for something.. You will damn near fall for Anything."

Lou Ferrigno: Michael Jackson Seemed Fine to Me Top

Lou Ferrigno
-- Michael Jackson's friend and fitness guru for decades -- tells TMZ MJ showed no signs of physical distress during workouts, as recently as 2 weeks before the singer died.

Lou's account differs from some of the statements in court -- that Michael was deteriorating in the weeks before his death.

Lou says two weeks before Jackson died, he went to MJ's home and trained him for an hour.  Michael did cardio on the treadmill, used the exercise ball, worked with some light weights, completed a bunch of core exercises, and did a lot of stretching.

Lou says Michael's energy level was very good, but he did complain that he was upset because he was having trouble sleeping.

Lou says he had been training Michael 2 to 3 times a week for the tour ... and aside from seeming "very stressed out," he appeared in good health.

And this is eerie ... Lou says as he left Michael's house the last time -- two weeks before MJ's death -- Jackson said, "Take care of yourself."  Lou said, "I'm going to see you next week."  Michael just repeated, "Take care of yourself."  Lou feels Michael knew something bad was about to happen.

Britney's Dad Scores 7 Figures in Femme Fatale Tour Top

Filed under: Britney Spears, Jamie Spears, Larry Rudolph, Music, Celebrity Justice, Exclusive

Britney Spears' daddy will get more than a million bucks -- possibly a lot more -- for his work as the manager of Britney's Femme Fatale Tour.

TMZ has obtained legal docs in Britney's conservatorship case, which show Britney's overall manager, Larry Rudolph, wants to give up 2% of his cut to Jamie, because daddy Spears has done such a great job -- Larry's cut is 10% of the gross.

We've learned Jamie has not gotten an extra penny for his work as Tour Manager -- a position he's held since February.

According to the docs, Jamie negotiated a sweet deal for Britney with Live Nation, the tour promoter.  He's also coordinated Britney's personal schedule, and supervised her arrivals and departures.  He's handled finances, managed Britney's security to protect her from the paparazzi and made 200 - 400 calls and other communications a day on Brit's behalf.

Even though Larry Rudolph is voluntarily giving 2% of his cut to Jamie, it still has to be approved by the court, but that's just a formality.

Tom Sizemore
is adamant ... he never should have been arrested at his L.A. apartment last week -- and TMZ has obtained the actor's proof ... a document stating he completed his required 80 hours of community service.

As we previously reported, cops arrested Tom on an outstanding battery warrant -- for allegedly failing to prove he completed his community service stemming from his 2009 spousal battery case.

But sources close to Sizemore tell us ... the actor insists the warrant was issued in error ... because he has a letter from the Hollenbeck Police Business Council proving he fulfilled his community service obligation.

Sources close to Tom tell TMZ, the actor's old attorney was supposed to file important documents with the court -- showing proof of completion of Tom's community service -- but never did ... so the court issued the warrant.

We're told Tom has hired a new lawyer -- who has filed the proof of completion -- and the clerical mess is finally cleaned up.

Chris Brown -- Victim of Fake Agent in Vancouver Concert Deal Top

Chris Brown
was targeted by a fake agent who setup and announced a concert date for the singer in Vancouver ... according to Brown's rep.

TMZ has obtained the cease and desist letter Chris' legal team fired off ... accusing a company called EJ Media Group of fraudulently presenting itself as a booking agent in order to organize a November 10 concert in Vancouver.

The concert was announced to the public today ... but Chris quickly tweeted that it was phony.

Brown's rep tells us they were alerted to the fake show when the venue -- the Pacific Coliseum -- contacted them. We're told the venue already wired $25,000 to EJ Media Group to secure the gig.

The cease and desist letter demands, among other things, that EJ Media return the money.

update_bar
EJ Media Group in New York City has contacted TMZ to say it is NOT involved in the Chris Brown concert fraud. A rep for the company points out the cease and desist letter was sent to a Broadway address -- but they're located on Fifth Avenue ... meaning, they're not the ones messing with Chris.

The rep says they are trying to figure out if someone else is illegally using their company name.

Michael Jackson's friend and choreographer, Kenny Ortega, just took the stand for the prosecution -- claiming Michael was ill in the days leading to his death ... and Dr. Murray berated him when he expressed concern.

* Ortega -- creator and director of "This Is It" -- says Michael was "very excited" about the show.
* Ortega said in mid to late June, 2009 Michael missed several rehearsals.
* On Friday June 19th, Ortega noticed Michael "wasn't right" and that something was going on. Ortega said it "troubled him." He said Michael seemed lost and was "incoherent."
* Ortega says he sat with Michael as he watched the rehearsals -- rubbing Michael's feet because the singer was freezing cold. Michael left early that day.
* Ortega says he was so worried about Michael, he sent an email to AEG Live CEO Randy Phillips (below) -- saying Michael needed psychological help.

0927_kenny_ortega_email_video2

*Ortega says he was confronted by Murray during a meeting at Michael's home on June 20th. Murray  told him he was upset Ortega didn't let him rehearse, berating him for acting like a doctor (video below).
* Ortega says on June 23, barely 4 days after Michael was sick, he came to rehearsals full of energy. Ortega said "it was a different Michael."
* On June 25th, Ortega got a phone call from AEG Live Co-CEO Paul Gongaware saying an ambulance had taken Michael to the hospital. Paul called later and told Ortega, "we lost him."
* During cross examination, Ortega told defense attorney Ed Chernoff, Murray was in charge of Michael's schedule leading up to his death.
* When asked whether he thought Michael was abusing drugs, Ortega said yes.
* Ortega said right before June 19th, Michael "went missing for about a week."

Mel Gibson -- I Didn't Agree to Pay Alexander $100,000 Top

Filed under: Mel Gibson, Oksana Grigorieva, Celebrity Justice, Exclusive

0927_mel_gibson_sasha_ex_FAMEMel Gibson is taking issue with legal documents filed by Oksana Grigorieva's lawyer -- which state that Mel paid $100,000 to Oksana's son Alexander Dalton, the son she had with actor Timothy Dalton.

Mel's rep tells us, "The deal between Mel and OG is exactly what was set forth on the record, in open court, on Augst 31, 2011" -- when Mel agreed to pay Oksana $250,000 as part of their custody settlement agreement.

His rep continues, "Mel is paying exactly the sums set forth to OG -- and is paying no additional sums to Alexander Dalton or anyone else."

"How OG chooses to have any sums due from Mel allocated is her business."

But as we previously reported, TMZ has obtained legal documents filed by Oksana's lawyer -- which claim, "Of the first $250,000 paid ... $100,000 belongs to Alexander Dalton who is waiving his rights to sue Mel Gibson and must be compensated for this to be lawful."

The docs continue, "If Alexander Dalton does not get his $100,000.00, he cannot waive his rights to sue. Mr. Gibson negotiated for that as a part of the settlement and is entitled to the benefit of his bargain."

MJ Trial - Defense Claims Michael Killed Himself Top

Filed under: Michael Jackson, Conrad Murray, Ed Chernoff, Celebrity Justice, Conrad Murray Trial

Ed Chernoff -- Defense Attorney's Opening Statement
Updated 9/27/11 at 11:00 AM

Dr. Conrad Murray
's attorney Ed Chernoff told the jury Michael Jackson caused his own death.

* Chernoff says the evidence will show MJ swallowed 8, 2 mg pills of Lorazepam.
* And Chernoff says MJ self-injected a dose or Propofol that created a "perfect storm" that killed him.
* There was no way to save MJ.  He died instantly.
* Chernoff told the jury what TMZ has reported for the last year -- that the centerpiece of the defense case is that Michael's death is on Michael -- not Dr. Murray.
* Chernoff also said MJ "had a problem" that no amount of determination could overcome, even with his talent, and without help he could not do the "This Is It" tour -- a tour that would score him more money than he had ever made on tour before.
* So, Chernoff says, Michael went doctor shopping.
* Dr. Murray is not a "celebrity doctor" -- he's a cardiologist who saves lives.
* The defense will put some of Dr. Murray's patients on the stand to show his level of care.  He would buy prescriptions for people who couldn't afford it and would generally go well above the standard of care expected of a doctor -- which contradicts prosecutors who call him greedy and reckless.  Murray seemed to tear up as he listened to Chernoff.

0927_conrad_crying

* Murray treated MJ for several problems, including toe fungus and a broken foot.
* Chernoff said Murray had no idea at the time that MJ had a much deeper problem
* MJ didn't have insomnia -- he had "an absolute, total and thorough inability to sleep."
* When Murray met with detectives 2 days after MJ's death, he thoroughly answered every question.  It was no holds barred and they hid nothing.  Chernoff said Murray told cops, "I don't know what killed Michael Jackson.  I want to know also."
* Michael Jackson told Murray the only way he could sleep was with Propofol and he always took Propofol.  MJ told Murray exactly how it was to be administered.  He even had a nickname for the drug -- milk.  MJ knew Lidocaine was essential in administering Propofol to prevent a burning sensation.
* MJ told Murray he would use Propofol with or without Murray, so Murray then agreed to provide Propofol.
* Dr. Murray provided Propofol for 2 months for MJ, and during that time the singer slept, woke up, and lived his life -- suggesting it wasn't negligent to administer the drug.
* The evidence is going to show is that Michael Jackson died when Dr. Murray stopped.  Murray told cops he believed his role was to find a way to help MJ sleep normally, urging him to get off Propofol.
* In other words, Murray was trying to ween MJ off Propofol and give him other, more traditional sedatives.  And, on June 22, 3 days before MJ died, Michael agreed to let Murray to try to get him off Propofol. And on that day Murray gave MJ half the Propofol he had been giving him.  And it worked. MJ slept.
* On June 23, Murray gave MJ NO Propofol at all, giving him other drugs instead.  And, on the day MJ died, the plan was not to give Propofol.  It was to go to other sedatives.  That's why in the recording,MJ pleads for the Propofol.  That's why Murray gave him other drugs instead during the night.
* Chernoff says MJ had certain "personality traits."   He kept various people in life separate from one another.
* Chernoff will present an addiction specialist, who will testify DR. ARNOLD KLEIN ADDICTED MICHAEL JACKSON TO DEMEROL.
* Things were so serious 5 days before Michael Jackson died, reps from AEG and others had a meeting at MJ's house and talked about "pulling the plug" on the tour.  And subsequently MJ made it clear to Murray -- he needed to sleep or the tour would go down in flames.
* Chernoff insists Murray only gave MJ 25 milligrams of Propofol just before MJ died -- and that is not enough to kill him.  Chernoff says MJ went to sleep, and Murray checked his pulse -- which was good.
Murray then sat and watched and left the room "only when I felt comfortable."  This may be the key to the case -- did Murray abandon MJ by leaving the room?
*  Chernoff says when Murray left the room "there was zero Propofol in his [Michael's] system."  Of course, what Chernoff is arguing is that Michael then shot himself up with the fatal dose.

* Chernoff came back from break the defense will show the amounts that Dr. Murray's death could not cause Michael's death.
* The science will prove there had to be more Propofol delivered to MJ's system after Dr. Murray left the room.
*The defense says MJ's stomach content had 4 times the amount of Lorazepam than in his blood, which means Michael would had to swallow the drug himself, after Murray left the room.
